Azione giudiziaria di Torrens Knight contro la decisione del Segretario di Stato di revocare la licenza di libertà

Shaun Woodward ha deciso per la sospensione della licenza di libertà (diritto sancito dal Good Friday Agreement), dopo che Torrens Knight è stato giudicato colpevole di aggressione di due donne in un bar di Coleraine, nel 2008.
Knight, condannato a 12 ergastoli per il massacro di Greysteel (Derry) e per l’uccisione di 4 operai a Castlerock, entrambi avvenuti nel 1993.
La difesa sostiene che la decisione di revoca avrebbe violato il suo diritto alla libertà e non avrebbe dovuto essere presa se non  dopo un ricorso contro la recente condanna di aggressione.
La Sentence Review Commissioners non si è ancora espressa formalmente circa la revoca della libertà di Knight, ma il lealista resta comunque in carcere.
Peter Coll, portavoce del Segretario di Stato, ha sostenuto che la decisione di sospendere la licenza di libertà sia stata adeguata al verdetto di colpevolezza nel caso di aggressione.
Il giudice Treacy si riservato il diritto di richiedere un riesame giudiziario del caso.

Greysteel killer launches legal challenge (U TV)
Convicted loyalist Greysteel killer Torrens Knight has launched a legal challenge to the decision to suspend his early release licence.
Shaun Woodward suspended his prison release after he was found guilty of attacking two women in a bar in Coleraine, Londonderry in May 2008.
Knight, who received 12 life sentences for his part in the massacre and the separate killing of four workmen, is seeking to judicially review the move by the Secretary of State.
His lawyers claim the decision breached his right to liberty and should not have been taken until after an appeal against the assault convictions is heard.
The High Court heard that the Sentence Review Commissioners have still to determine whether to revoke the licence granted under the Good Friday Agreement.
Knight was sentenced to four months imprisonment last December for assault and disorderly behaviour.
Although granted bail pending his appeal, he was kept in jail due to the suspension of his licence.
Knight was found guilty of involvement in an attack on the Rising Sun bar in Greysteel, Derry at Halloween 1993. Eight people were shot dead when loyalists opened fire inside the pub.
He was also convicted of the murders of four Catholic builders in Castlerock earlier the same year.
Peter Coll, for the Secretary of State, argued that the decision to suspend his licence was appropriate due to the guilty verdict in the assault case.
Mr Justice Treacy reserved judgment on whether to grant leave to seek a judicial review.
