The Five Demands

Sull’onda dell’esito positivo dell’azione civile sulla strage di Omagh che ha portato alla condanna di quattro membri del Real IRA (Michael McKevitt, Liam Campbell, Seamus Daly e Colm Murphy), il FAIR (Families Acting for Innocent Relatives) guidato da Willie Frazer, ha annunciato oggi un nuova azione legale contro 5 prominenti repubblicani.
Due appartengono al Provisional IRA di South Armagh, uno è originario della Repubblica, il quarto è di Tyrone ed il quinto è un ‘elemento di spicco’ ancora del Provisional IRA.
Stando alle dichiarazioni di Frazer, si tratta di ‘figure repubblicane’ implicate in atti terroristici per decenni e pertanto sono nomi ben noti al PSNI.
L’azione legale condotta dal FAIR dovrebbe indicativamente già avere inizio alla fine di agosto.
Gli avvocati che condurranno il procedimento stanno collaborando con un team statunitense e con degli esperti in legislazione europea sulla tutela dei diritti umani.
Frazer ritiene che tale azione sia l’unico modo per porre fine al ‘regno del terrore’ repubblicano.
“Questo è un giorno davvero memorabile per le vittime, dato che abbiamo compiuto il primo passo sulla strada della giustizia e, grazie a questo, verso la pace”.
“Il governo ha sprecato milioni cercando di spiegare come trattare con il passato, e abbiamo visto ogni sorta di compromesso e l’abbandono del senso comune”.
Il presidente del FAIR ha poi aggiunto che è arrivato il momento di scuotere l’Irlanda del Nord nelle ‘sue fondamenta’.
“Abbiamo promesso alle vedove e agli orfani che giustizia sarà fatta. A  differenza dei governi e dei politici, manterremo le nostre promesse”.
“Questa non sarà una strada facile, ma siamo fiduciosi”.
“Arriviamo dopo di loro e dobbiamo aggiungere agli elementi di prova già accumulati, registrazioni e  testimonianze di agenti di polizia esperti e di ufficiali dell’ intelligence che sanno esattamente ciò che questi uomini hanno fatto.”
Frazer ha sottolineato che l’azione legale non sarà finalizzata solo al denaro, ma sarà un modo per dimostrare a quei repubblicani che ‘il terrorismo non paga’.
L’evenutale introito economico verrebbe impiegato nell ‘lotta per la giustizia’ delle vittime dei Troubles.

Victims’ group to take legal action against republicans (NewsLetter)
Five alleged republicans are to be “personally served” writs by Co Armagh victims’ campaigner Willie Frazer in a move to take legal action against them.
Among them, Mr Frazer revealed, are two senior Provisional IRA men from south Armagh.
Another is originally from the Republic, a fourth from Co Tyrone, and a fifth he described as “a senior PIRA figure”.
The victims’ campaigner said: “The aim is that when the courts reconvene at the end of August we will be ready to move against senior republican terrorists.
“We intend to serve writs on five top republicans who have been involved in terrorism for decades.”
Mr Frazer, who heads up Markethill-based group FAIR, said that barristers from the mainland and experts in European Human Rights law had been working with a team from the United States.
And he said such action was the only way to end the republicans’ “reign of terror”.
Commenting on the individuals involved he said they were “well known to the police” and had been “chosen for a number of obvious and practical reasons”.
Mr Frazer said that it had been the successful civil case brought by the families of the Omagh bombing that had “created the necessary precedent” for his group to go down this route.
He said: “This is a truly momentous day for victims as we have taken the first step on the road to justice and, through that, peace.
“The Government has wasted millions talking about how to deal with the past, and we have seen all manner of compromise and the abandonment of common sense.”
The victims’ campaigner said the case would “shake Northern Ireland to its foundations”.
“We have promised the widows and the orphans that justice will be done and unlike governments and politicians we keep our promises,” he said.
“This will not be an easy road but we are confident.
“We will be going after them and we have to add to the evidence already amassed the records and expert testimony of police officers and intelligence officers who know exactly what these men have done.”
Mr Frazer stressed that the legal action was not about money – although he said FAIR intended to strip these republicans “and their illegal organisation of its assets to show the world that terrorist crime does not pay”.
Money retrieved would be used to continue the victims’ fight for justice, he said.
