LIAM CAMPBELL AFFRONTERA’ IL PROCEDIMENTO DI ESTRADIZIONE IN IRLANDA DEL NORD

Liam Campbell, sulla cui testa pende un richiesta di estradizione da parte del governo lituano per l’accusa di contrabbando di armi, dovrà affrontare il procedimento in Irlanda del Nord nonostante fosse già stato avviato nella Repubblica.
Campbell, 46 anni di Dundalk, era stato arrestato lo scorso maggio subito dopo aver attraversato la frontiera per accompagnare la moglie al lavoro in un paese della contea di Armagh.
Egli è uno dei quattro membri del Real IRA condannati nella causa civile per la strage di Omagh.
Il giudice ha stabilito che il processo di esecuzione del mandato d’arresto europeo si concluderà in Irlanda del Nord e ha indicato l’opposizione al rilascio su cauzione dicendo di non aver “alcuna fiducia” sul ritorno di Campbell  in Irlanda del Nord, in occasione delle udienze.
Il governo lituano si è detto favorevole al proseguimento del procedimento in Irlanda del Nord, anche se il giudice ha affermato che se Campbell non avesse attraversato il confine non ci sarebbero state ragioni per il trasferimento.

A Belfast judge has ruled that Omagh bomber Liam Campbell will have to face extradition proceedings in Northern Ireland. The dissident republican of Upper Faughart in Dundalk is wanted in Lithuania after a foiled plot to bring weapons and explosives into Ireland. The 46-year-old was arrested in May when police swooped as he left his wife to work in the Co Armagh village of Bessbrook. In the dock Campbell, one of four men found liable for the single worst atrocity of the Troubles, showed little emotion as the judge rejected submissions to have him returned to the Republic where extradition proceedings are advanced. Belfast Recorder Judge Burgess ruled that the process of execution of the European Arrest Warrant should conclude in Northern Ireland and indicated he would oppose bail saying he had “no confidence” that Campbell would return to Northern Ireland for the legal hearings. The judge described the situation as unusual and said there was no specific provision in the Framework Decision which provided for the setting up of the EQW. He said he had contacted the authorities in Lithuania and they indicated they would prefer Campbell faced proceedings in Northern Ireland. The judge said: “The judicial authority issuing this warrant sent it to Northern Ireland and to the Republic of Ireland at or about the same time, in circumstances where they would have no control over, or knowledge of, within which jurisdiction it may be executed. “In the event, in January of this year, it was executed in the Republic of Ireland and matters would have rested there if Mr Campbell had remained there. “He chose to come to this jurisdiction and the PSNI arrested him under the warrant which had been certified by SOCA on January 9 2009. For reasons that I have stated, I find no reason to impart to the PSNI any bad faith or abuse of their powers. They were arresting someone under an instrument duly issued by a judicial authority in a Part 1 territory. \[Clare Palmer\]That judicial authority has advised that it wished the matter to proceed in this jurisdiction. “On the facts in this case I find no reason to utilise any of those powers. “The submissions on behalf of Mr Campbell are rejected and the matter will be time-tabled to conclusion of the execution of the arrest warrant in Northern Ireland.” Campbell was remanded ahead of a bail application .
