TERRY McCAFFERTY RICORRE ALLA CORTE SUPREMA

I legali del dissidente repubblicano hanno presentato ricorso alla Corte Suprema di Londra contro la revoca della licenza avvenuta nel dicembre 2008

Terry McCafferty, 41 anni di North Belfast, è deciso a ribaltare la decisione del Ministro della Sicurezza, Paul Goggins, di revoca della licenza di libertà, ricorrendo alla Corte Suprema di Londra.
McCafferty venne condannato a 12 anni di carcere per possesso di esplosivo, per poi essere rilasciato in Novembre 2008 e riarrestato il mese successivo perchè ritenuto fonte di rischio per la comunità.
I legali del dissidente repubblicano sostengono che solo il Segretario di Stato Shaun Woodward, avrebbe potuto prendere una tale decisione.
Un primo ricorso alla Corte di Appello è stato respinto da 3 giudici che hanno svelato i motivi che hanno portato Paul Goggins, alla revoca della licenza. Il repubblicano è ritenuto elemento di spicco del Real IRA, oltre ad essere stato Officer Commanding dei prigionieri del RIRA durante la detenzione nel carcere di Maghaberry fino al suo rilascio. Sempre secondo le motivazioni rese note in occasione del ricorso alla Corte di Appello, McCafferty starebbe attualmente mantenendo contatti con il gruppo paramilitare repubblicano e sarebbe coinvolto nella pianificazione di nuovi attentati.
McCafferty continua a negare ogni accusa.

RIRA accused to challenge jailing (BBC News Northern Ireland)
A man returned to jail on intelligence he was a Real IRA leader planning terror attacks, is to take a legal challenge to the UK’s highest court.
Terence McCafferty, 41, from north Belfast, is seeking to overturn a decision by Security Minister Paul Goggins to revoke his licence.
His lawyers argue only Secretary of State Shaun Woodward had the power to order his return to prison.
They say they will petition the Supreme Court over the decision.
McCafferty, who is from the New Lodge area, has previously lost an appeal against Mr Goggins’ decision.
He was jailed for 12 years in July 2005 after being convicted of possessing explosives.
He was then released on licence last November, only to be rearrested the following month and returned to Maghaberry Prison.
Mr Goggins authorised the revocation on the grounds that his continued liberty would put the public at risk and the possibility of further offences.
McCafferty sought to overturn the decision in the Court of Appeal, but this was dismissed
On Wednesday, McCafferty’s legal team sought certification to take the case before the Supreme Court in London on a point of law of general public importance.
Their request was refused by a three-judge panel sitting in the Court of Appeal, but a solicitor for McCafferty later confirmed his intention was now to petition the Supreme Court directly.
When dismissing the appeal last month, judges set out the contents of a letter from the security minister Mr Goggins giving reasons for revoking his licence.
‘Officer commanding’
It stated: “In reaching that decision Paul Goggins had regard to information made available to him that you are a leading and active member of the Real Irish Republican Army (RIRA), who held the position of officer commanding of RIRA prisoners within HMP Maghaberry prior to your release from prison in November 2008.
“During your sentence, you remained in regular contact with senior RIRA members and involved in directing RIRA business, and displayed a clear desire to continue your involvement in RIRA activity on your release, including in becoming involved in plans for attacks that would present a threat to public safety.
“From immediately on your release you have been in regular contact with leading RIRA figures. It is assessed that you have taken up a leading role in the organisation and have been involved in plans to conduct attacks.”
McCafferty denies the allegations in the letter, which was contained in a summary of the nine-page Court of Appeal judgment.
